The EEOC states that consideration of arrests and criminal convictions can result in unintentional discrimination.

And, recently, the agency has been paying close attention to employers that consider arrest records that don't lead to convictions as well as those that systematically deny candidates  with criminal records.

Why We Don't Report Non Convictions

Employers often assume that if someone was arrested, that person has been convicted of a crime. However, this isn't always the case. An arrest is the start of a set of legal procedures – and the result isn't always conviction.

Omitting non-convictions from background checks levels the playing field for job applicants whose arrests never led to conviction. It also protects employers from lawsuits over failing to consider that  the arrest didn't lead to conviction.
